ProductionDate vs. CreationDate
Both the RevenueReport
message and RevenueDetails
message enable the communication of data about revenues generated in respect of a sound recording/music video is in an audio-visual resource that has been reported to a music licensing company or a rights controller.
This is specifically important for the use of music in audio-visual content, for example, full-length concerts or TV programs and should not be confused with revenues generated from music videos.
In the RevenueReport
the RD02.01
Record is specific to the use of revenues generated from audio-visual resources or releases and can communicate the same data points that can also be communicated in the SRD1 Records of the RevenueDetails message.
There are, however, two cells in the RD02.01
and SRD1
Records that are specific to the audio-visual content. These are the production and creation dates, the Cell names for which are AudioVisualProductionDate and AudioVisualCreationDate. Both are optional.
In line with the data requirements for the creation of a musical work and the subsequent fixation/manifestation of such in a sound recording, which can then be exploited and consumed, the audio-visual world distinguishes between the creation and the production of an audio-visual resource, typically expressed by a single date for the year (YYYY.)
Every audio-visual resource or release has a production date that specifies the time of fixation from which moment the legal IP comes into force and hence revenues need to be collected and paid. The most important data point here is the year entered in the AudioVisualProductionDate
Cell, which determines all the legal and financial implications that flow from that date. (Also refer to the Berne Convention for the Protection of Literary and Artistic Works.)
The field definitions provided in the RDR-R standard are currently as follows:
AudioVisualProductionDate
is defined as “The date when the audio-visual resource was produced, in the ISO 8601 format: YYYY[-MM[-DD]].”
AudioVisualCreationDate
is defined as “The date when the audio-visual resource was created, in the ISO 8601 format: YYYY[-MM[-DD]].”
The aim is to refine those definitions in the next version of the RDR-R messages following close consultation with the SCAPR AV Forum. In the meantime, the following serves as a clarification of the existing definitions to clearly distinguish the data sets expected in both those data fields in RDR-R.
Please note that the advice given by SCAPR suggests that the AudioVisualProductionDate
should become mandatory, while the AudioVisualCreationDate
for the purpose of RDR-R should either remain optional or be deprecated as few of the SCAPR AV societies actually use creation date. Where that Cell is used, there is not one single definition applied across territories.
AudioVisualProductionDate
- The date when the audio-visual resource has been fixed from which it then can be perceived, reproduced, or otherwise communicated, and copyright automatically starts to take effect. The date provided is the year the production has been completed and is ready for publication. Typically, this is the same date as the date of first release.
AudioVisualCreationDate
– The date when the audio-visual resource has been commissioned and subsequently conceived. This date may take place significantly before the start of the process to express and fixate the audio-visual resource (seeAudioVisualProductionDate
).
